Privacy and Cookie Policy

1. Introduction

SwingIQ helps golfers analyse their golf swing by comparing a current swing to a reference swing they selected themselves.

In order to provide this service, we process personal data in accordance with the General Data Protection Regulation (the "GDPR").

This policy applies to the use of the SwingIQ application, website and associated digital services.

2. Who is responsible for your personal data?

Hereinafter: "SwingIQ", "we", "us" or "our".

3. Which personal data do we process?

• Account and registration data: email address; display name; password (hashed); language preference; role; the organisation or tenant you belong to; subscription/plan.
• Golfer profile: data you enter during registration (or later in the app) such as name; left- or right-handedness; sex; body height; date of birth; golf handicap. Not all data is mandatory. Sex and height are optional, and where data is optional we use it only for the purpose for which it was provided to us.
• Swing videos and analysis data: SwingIQ consists of recording, uploading and analysing golf swings. We may therefore process the following data: swing videos; thumbnails; pose/posture points (skeleton, head, shoulders, elbows, wrists, hips, knees, ankles); extracted audio (impact); the swing's phase breakdown; ball positions; swing analyses; coaching insights and your selected "best shots".
• Capture and device data: device type; a pseudonymous device identifier; capture settings (such as frame rate) and timestamps.
• Location data: location data is processed only where the User has given consent, in which case the location may be used to determine, for example, the name of a golf course. Location functionality is off by default unless the User activates it.
• Technical log data: diagnostic logs with correlation, tenant, user and video identifiers to operate the service and troubleshoot issues. Passwords and tokens are never logged.

4. What do we use personal data for?

We use personal data for:

• Providing SwingIQ: managing Accounts; authentication; receiving and analysing swing videos; generating coaching feedback; storing best swings.
• Personalisation: adapting the user interface; tailoring analyses to the golfer; personalising coaching feedback.
• Improving the service: improving quality and reliability by reviewing analyses; investigating incorrect detections; carrying out manual corrections; analysing technical errors; improving algorithms and detection methods.

5. Legal bases

We process data on the basis of performance of the contract (providing the service), your consent (e.g. location and analytics cookies), our legitimate interests (security and improvement of the service) and, where applicable, a legal obligation.

6. Who do we share personal data with?

We do not sell personal data. We may share personal data with parties that are necessary for providing, securing and supporting SwingIQ, such as hosting and cloud providers (for hosting, storage, databases, processing), AI services to generate coaching text or other analyses, and sub-processors with whom we conclude appropriate processing agreements. Specifically, this currently concerns:

• hosting and cloud infrastructure for storage and processing;
• AI services (for example Azure) that generate coaching text from data derived from your swing, and that process the part of your email address before the @ once, at registration, to suggest a name to address you by. We consult no external sources about you for this; the suggestion comes solely from that piece of text, and you can change the name in the app;
• an email service for account and security messages (such as verification and password reset);
• OpenStreetMap/Overpass to look up a course name, only if you have enabled location.

Within an organisation/PRO tenant, your golfer data may be visible to that tenant's administrator or coach.

7. Retention

We do not keep personal data longer than necessary for the purposes for which it was collected, unless a longer retention period is required or permitted by law.

We keep your data while your account is active and for as long as needed for the service. Videos and derived artefacts are retained until you delete them or according to our clean-up policy. Logs are kept for a limited period. When you delete your account or data, it is deleted or anonymised, except where we are legally required to retain it.

The exact retention period may differ per category.

8. Security

We take appropriate technical and organisational measures to protect personal data, including encrypted connections, secure storage of passwords, data separation per tenant and access controls.

9. Your privacy rights

Under the GDPR, and depending on the circumstances, you have the right to access, rectification, erasure, restriction, portability and objection, and you may withdraw consent you have given. You can also lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens). To exercise your rights, contact us by email at info@cooperatie-yaad.nl.

10. Minors

SwingIQ can be used by young golfers.

We do not direct SwingIQ specifically at children under 16 without appropriate consent where the law requires such consent.

11. Cookies and local storage

SwingIQ uses local browser storage rather than tracking cookies:

• Necessary (always active): for login/session (authentication tokens) and remembering your cookie choice. The app does not work without these.
• Analytics (optional): only with your consent, to understand how SwingIQ is used and to improve the app.

We do not use third-party advertising or tracking cookies. You can change your choice at any time via "Cookie settings".

12. Changes to this Privacy and Cookie Policy

We may amend this Privacy and Cookie Policy where this is needed because of changes in laws and regulations, changes to SwingIQ, new features or technical changes.

The most current version is made available through the SwingIQ app and/or website.
